Faskh-e-Nikah
🔹 Taaruf
Nikah Islam mein ek muqaddas moahida hai jo mohabbat, zimmedari aur shar’i usoolon par qaim hota hai. Lekin baaz auqaat aulad-e-zindagi mein aise haalaat paida ho jaate hain jahan zulm, na-insafi ya shadeed na-pasandidgi ki wajah se rishta nibhana mumkin nahi rehta. Aise moqa par shari’at ne “Faskh-e-Nikah” ka rasta diya hai — jo talaaq ya khula se mukhtalif ek alag shar’i amal hai.

🔹 Faskh-e-Nikah ka Mafhoom
“Faskh” ek Arabi lafz hai jiska matlab hai “moahida khatam karna”.
Faskh-e-Nikah se muraad hai ke nikah ko shar’i bunyadon par baatil qarar dena — yeh sirf Qazi ya Mufti ke hukm se mumkin hota hai, aur is ke liye wazeh shar’i wajah zaroori hoti hai.

🔹 Faskh-e-Nikah ki Shar’i Bunyaden
1. Nafaqa ki adam adaigi
Agar shauhar biwi ka kharch (khana, libaas, rehaish) shar’i tor par poora nahi kar raha.
📚 Fiqhi daleel: Hazrat Umar (r.a) ne aise shauhar se biwi ko juda kiya jis ne nafaqa band kar diya tha.
📘 Masnaf Ibn Abi Shaybah
2. Jismani ya Zehni Aziyat
Agar shauhar biwi ko maare, gaaliyaan de ya zehni dabao mein rakhe.
📚 Fiqhi usool: Zulm ki surat mein Qazi faskh ka hukm de sakta hai.
3. Shauhar ka taweel ghiyab ya laapata hona
Agar shauhar kai mah ya saalon se ghaib ho aur biwi ko koi khabar na ho.
📘 Fiqh Hanafi mein aise haalaat mein faskh jaiz hai, bashart-e-tahqiqat
4. Talaaq dene se inkaar
Agar biwi shar’an alag hona chahti hai aur shauhar inkaar kare.
📚 Hazrat Usman (r.a) ne aisi aurat ko faskh ki ijaazat di jiska shauhar talaaq nahi de raha tha
5. Nikah mein dhoka ya ghalat bayani
Jaise bimari, maali haalat ya aqeeda chhupaya gaya ho.
📘 Fiqha ne farmaya ke dhoka ki bunyad par nikah faskh kiya ja sakta hai

🔹 Faskh-e-Nikah ka Shar’i Tareeqa
1. Tahreeri Darkhwast
Biwi ya uska wali Qazi ya Mufti ke samne tahreeri tor par darkhwast pesh kare, jisme wajah aur shawahid darj hon.
2. Tahqiqat aur Sama’at
Qazi dono fareeqon ko sun kar shar’i daleel ka jaiza leta hai.
3. Shar’i Faisla aur Sanad
Agar daleel mukammal ho to Qazi faskh ka hukm jari karta hai, aur ek Sanad-e-Faskh tayar ki jaati hai.
4. Iddat ka Ta’ayyun
Faskh ke baad biwi ko iddat guzaarni hoti hai — jo talaaq ki iddat se mukhtalif ho sakti hai.

🔹 Hadees ki Roshni mein
Waqia: Hazrat Thabit bin Qais (r.a)
Unki biwi ne Nabi Kareem (s.a.w) se arz kiya:
“Main unse nafrat karti hoon aur nahi chahti ke kufr mein mubtala ho jaoon.”
Aap (s.a.w) ne farmaya:
“Kya tum unka baagh wapas kar dogi?”
Aurat ne kaha: “Ji haan!”
To aap (s.a.w) ne farmaya:
“Baagh wapas kar do aur unse alag ho jao.”

📌 Fiqha ne is hadees se khula aur faskh dono ke usool akhz kiye.

🔹 Aham Shar’i Ehityaat
- Faskh-e-Nikah sirf Qazi ya Mufti ke zariye mumkin hai
- Har faskh ki tahreeri sanad zaroori hai
- Faskh ke baad iddat laazmi hai
- Faskh ka faisla shar’i daleel aur gawahon par mabni hona chahiye
- Jazbaat, dabao ya ghair-shar’i wajah par faskh jaiz nahi

🔹 Nateeja
Faskh-e-Nikah ek shar’i amal hai jo biwi ko zulm se bachane ke liye diya gaya hai. Iska istemaal sirf ilmi, shar’i aur samaji shaoor ke saath hona chahiye. Har Qazi, Mufti aur khandan ko chahiye ke is maslay ki nazakat ko samjhe, aur har qadam shari’at ki roshni mein uthaye.
