The Shar’i Right of Maintenance and Housing After Nikah



🔹 Topic:


Many men neglect their Islamic responsibilities after marriage — they neither provide maintenance (nafaqa) nor arrange proper housing (makan) for their wives.  

This is not just negligence, it is oppression. In Islam, nafaqa, clothing, and housing are the wife’s rights — and failing to fulfill them is a major sin.

📘 Qur’anic Guidance:


> “Men are caretakers over women… and they spend from their wealth.”  

> (Surah An-Nisa, Ayah 34)


📌 This verse clearly defines the man’s duty — to provide for his wife, protect her, and arrange housing and comfort.

📗 Hadith:


> “The best among you is the one who is best to his family.”  

> (Tirmidhi Sharif)


📌 The best man is the one who treats his wife with kindness, provides for her, and honors her.

⚠️ The Problem Affecting the Ummah:


- Leaving the wife at her parents’ home after nikah  

- Not providing nafaqa, clothing, or housing (makan)  

- Denying her rights by saying “rukhsati hasn’t happened”  

- Only remembering the wife during divorce or disputes — otherwise neglecting her

📌 The Role of Qazaath:


- Every marriage must include clear guidance on nafaqa and housing  

- These rights should be mentioned in the Nikahnama  

- The wife’s rights must be taught and protected  

- Men must be Islamically educated about their responsibilities

کچھ یادوں کی ڈائری سے والد کی   والد صاحب کے بچپن کادورجس درد بھرے ماحول میں گزرا،دعا ہیکہ کسی کا بچپن اُسکی معصومیت نہ چھین لے،آپ بچپن میں ہی یتیم ہوگئے تھے۔پولس ایکشن جیسے حالات میں آپ کو جہاں باہری حالات سے تحفظ کو بھی خطرہ تھا،زمینداری زیادہ ہونے کی وجہ سے خود اپنوں کی سازشوں کا ڈر بھی تھا۔ایسے حالات میں تب آپ کی خالہ نے اپنے بچے کی طرح پرورش کی۔ ٓٓآپ اپنی دن بھر کی کارگزاری اورمعمولات ہمیشہ ڈائری میں لکھا کرتے تھے۔اصول اور وقت کے حد درجہ پابند تھے۔ عموماً آج ہمارے سماج میں گھر کا کوئی فرد مسجد جائے۔اس دوران کوئی جان پہچان کے لوگ آکر پوچھے کہ کہاں ہیں اور کب آئیں گے۔تو جواب دیا جاتا ہے مسجد گئے ہیں اور بس ابھی پانچ دس منٹ میں آئینگے۔یعنی یقینی طور پرجلد آنے والے ہیں۔ اور اگر کہیں بازار یا دوسری جگہ جائے اور آنے کے تعلق سے پوچھا جاتا ہے تو کہتے ہیں بازار یا کسی جگہ باہر گئے ہیں اور پتہ نہیں کب تک آئینگے۔اِس کے بر عکس والد صاحب کے معمولات سے ہم آگا ہ تھے جب کوئی صاحب آپ کی غیر موجودگی میں آتے اور آپ مسجد گئے ہوں تو آپ کے آنے کا یقینی وقت نہیں بتا سکتے کہ کب تک آسکتے ہیں کیونکہ نم...
