The Crisis of Uncertified Divorce and the Disrespect of Marriage

🔹 Topic:


Nowadays, many people issue divorce impulsively — through WhatsApp, in anger, or without appearing before a qualified Qazi.  

There is no written certification, no proper determination of the waiting period (iddat), and no regard for the wife’s dignity.  

Such actions are neither valid according to Islamic law nor acceptable in a civil society.

📘 Qur’anic Guidance:


> “When you divorce women, do not expel them from their homes during their waiting period…”  

> (Surah At-Talaaq, Ayah 1)


📌 This verse emphasizes the etiquette and timing prescribed by Shari’ah during divorce — protecting both dignity and due process.

📗 Hadith:


> “Three matters are such that even joking about them counts as reality: Nikah (marriage), Talaaq (divorce), and Rujoo (reconciliation).”  

> (Sunan Abu Dawood)


📌 This Hadith confirms that even a divorce uttered in jest becomes legally binding under Shari’ah —  

which is why every word, every moment, and every intention must be accounted for.

⚠️ The Problem Affecting the Ummah:


- Divorce via WhatsApp or SMS — without certification, witnesses, or a Qazi  

- Abandoning the wife without observing iddat — no knowledge, no protection  

- No safeguarding of the wife’s dignity or future after divorce  

- Defaming the wife post-divorce — even though Shari’ah requires respect after separation

📌 The Role of Qazaath:


- Every divorce must be documented with a proper certificate  

- The waiting period (iddat) must be determined by a qualified Qazi  

- Guidance must be provided to protect the wife’s dignity and future  

- Misuse of divorce terminology must be prevented — every word carries legal weight in Islam
